How much trouble could my son be in?

My son is a senior in high school. He just turned 18yo. He and his friends received nude photographs of girls in their class and sent them to each other. The school found out and have indicated that law enforcement has been contacted. Can the school expel him if this behavior happened outside of school hours? And how much trouble is he looking at with the police?


Answer

This is a very serious situation, and your son certainly could be in trouble at school and, more importantly, criminally. The age of the girls in the photos is a critical factor. If they were 17 or younger, your son and his friends could be facing criminal charges of possession and distribution of child pornography. Even if the girls are 18 – adults – they could be facing criminal charges involving nonconsensual dissemination of private images. (This conduct is sometimes referred to as “revenge porn.”) Since your son is 18, he will also be facing any and all criminal charges as an adult in adult court. An attorney should be consulted immediately due to the potential magnitude of the criminal charges against your son.
