‘Arrested for DWI thanks to a private citizens report. What do I need to do to get the callers full report?’
Answer
You can go to the police department and request a copy of the report; however, it likely will be a redacted version. The complete version would be disclosed through the court process. All evidence that the prosecutor possesses must be disclosed. The comprehensive police report and 911 recording, can be obtained through the discovery process in the case.
In addition to the criminal case, you have the opportunity to challenge the associated civil loss of license; however, you must act quicky. You are allowed to file for review of the revocation through the judicial process within 60 days of receiving notice of the revocation. The judicial petition must state specific legal grounds to justify the challenge. It is important to seek judicial review in an attempt to avoid the loss of license and increased insurance premiums.
